New York has enacted a groundbreaking and highly debated law that will soon require social media platforms with certain “addictive” features to display prominent mental health warning labels aimed at protecting young users, a measure that reflects growing concern among lawmakers about the psychological effects of digital platforms on children and teens and adds the state to a patchwork of jurisdictions pushing for more regulation of Big Tech.
Governor Kathy Hochul announced on December 26 that the legislation, signed into law after approval by the state legislature, targets platforms offering infinite scrolling, auto-play videos and algorithmically curated feeds features critics say are designed to keep users engaged for as long as possible. The law requires these companies to embed visible warnings about potential harms to mental health when such features are accessed by young people, a step intended to give families and users clear notice of risks associated with extended use of these services.
Under the new requirements, social media companies operating in New York will have to display these warning labels to users whose online activity falls under the state’s jurisdiction. That includes initial exposure to what the law describes as “predatory features” and periodic reminders during continued use, ensuring that the cautionary messages are not simply a one-off notice but part of an ongoing effort to raise awareness of potential mental health effects. The law defines key features of concern broadly enough to encompass major platforms such as TikTok, Instagram, Facebook, Snapchat and YouTube, all of which use algorithmic feeds and auto-play designs that have been linked in studies to anxiety, depression and addictive behaviors among youth.
Governor Hochul framed the new mandate as a public-health effort akin to warning labels on tobacco products or suffocation warnings on plastic packaging, emphasizing that the goal is not to punish technology companies but to ensure transparency and protect vulnerable populations. In her statement, she linked the measure to a larger set of statewide efforts aimed at addressing a youth mental health crisis that has intensified in recent years, citing research showing that adolescents who spend extended periods on social media are more likely to report symptoms of anxiety, depression and poor body image. By requiring platforms to offer explicit alerts about these risks, the state aims to empower families and young users with information that can influence how they interact with digital environments.
The law allows the New York attorney general to enforce these requirements and seek civil penalties of up to $5,000 for each violation, putting real legal weight behind the mandate. While the law applies to conduct occurring entirely or partly within New York’s borders, it does not extend to users outside the state, a provision that reflects the legal and practical limits of state authority in regulating global technology platforms. The law’s passage comes amid a broader national and international focus on the impact of social media on youth mental health. Earlier in 2025, the U.S. surgeon general called for warning labels on digital platforms, and several school districts and municipalities have pursued litigation against major social media companies over alleged harms and addictive design features. Australia has gone even further by imposing a nationwide ban on social media use by children under the age of 16, a policy that has drawn both praise and controversy as governments grapple with how to balance safety with freedom of access to information. These global developments illustrate a wide spectrum of approaches, from outright bans based on age to warning labels and age-verification laws that regulate how platforms interact with younger users.
Within the United States, New York’s strategy sits alongside other state-level initiatives aimed at curbing potential harms from social media. Legislation like the SAFE For Kids Act, passed earlier in New York, requires age verification and parental consent before minors can access algorithmically driven feeds, while other states have pursued measures that restrict notifications to minors during late-night hours or limit the collection of children’s data. These policies reflect a growing recognition among policymakers that traditional consumer protections may be insufficient to address the unique ways in which digital technology interacts with young minds, and that new forms of regulation may be needed to ensure safe environments for children online.
