In what has become one of the most pointed critiques of the United Kingdom’s 2023 Online Safety Act, social media platform X owned by Elon Musk issued a formal statement on August 1 warning that the law, while aiming to protect children from illicit content, has instead opened the door to widespread censorship of entirely legal speech under the guise of safety.
According to X’s assessment, the Online Safety Act imposes broad, aggressive mandates on platforms such as Facebook, YouTube, TikTok, and X itself, along with websites hosting adult content. The platform has publicly stated that compliance alone is insufficient because the threat of fines up to £18 million or 10% of global revenue has created a chilling legal environment. Content moderators and developers feel compelled to adopt an overly cautious approach, removing content that regulatory guidance has not specifically deemed illegal, which may suppress public discourse.
The heart of the concern lies in the Act’s implementation, which while designed by lawmakers to increase "online safety," may have inadvertently eroded the balance between protection and expression. X summed this up bluntly in its statement: “When lawmakers approved these measures, they made a conscientious decision to increase censorship in the name of 'online safety.' The law has already sparked controversy beyond the corporate sphere. More than 468,000 individuals have signed an online petition calling for a full repeal. Users have described age‑verification mechanisms as invasive, especially since they require submission of personal data to access any adult site. The move has prompted heated debates over privacy protections versus state regulatory authority. Political backlash grew strongest from free‑speech advocates and entertainment creators stating the Act extends beyond preventing illegal content and into content that is merely sensitive or dubious.

Critics emphasize that a healthy digital ecosystem requires platforms to support content of journalistic or democratically important nature, and applying blanket moderation powers could chill legitimate discourse across public and academic forums.
Privacy specialists also focus on a single troubling provision of the Act that empowers the Secretary of State to issue emergency directions overriding Ofcom’s authority. Legal scholars argue this grants ministers unchecked control over digital speech policy without sufficient judicial oversight. Encryption advocates, including major tech companies like Apple and WhatsApp, have voiced concerns that scanning for child pornography content may require compromising end‑to‑end encryption, posing risks to personal privacy for all users not just UK residents.
Meanwhile platforms with a global presence express worry that UK-specific laws might spill over. They point to Reddit and Bluesky as examples both now planning to implement UK‑only age barriers to comply with the Act. Smaller community sites have threatened to block UK traffic altogether rather than undertake the risk and cost of compliance. This fragmentation, critics argue, could reshape internet services into siloed regions defined by national laws rather than universal norms of expression and privacy.
Supporters of the Act, including nonprofit groups working on child safety, insist the law strikes a responsible balance. They argue it is better to err on the side of caution when protecting minors, and that platforms must be prepared to act decisively to prevent abuse. Ofcom has stressed that the law includes duties to preserve journalistic and public interest content, though critics say operationalizing those exceptions has already proved difficult within opaque automated systems.
